Called to Order:  7:30 PM under the M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5.  by Philip R. Lindquist, Chairman, in the Conservation Office on the second floor of Town Hall.

Public Hearings

7:45 PM  Notice of Intent for the installation of a septic system and leaching field within the 100-foot buffer zone at 105 South St., Assessor's Map 24, Lot 37A for Judy Binder, 28 Elmer Ave., Pembroke, MA represented by Grady Consulting, LLC, P.O. Box 308, Kingston, MA  02364
(DEP #175-439)  (New Hearing).

Craig Nicholson read the Public Hearing Notice and the green cards were checked.  Darren Grady of Grady Consulting, LLC presented the proposal for a septic upgrade.  The existing cesspool is to be pumped, filled and replaced with a gravity system.  Ms. Delaney had inspected and reported that there is a lot of debris in the wetlands.  The owners are eager to get rid of it and it can be done by hand.  Mr. Lindquist read off the abutters list.  None were present.  However,  abutters William Ketchen & Martine Ortiz, owners of 83 South St. had written a letter in objection to the project citing the Rivers Protection Act.  Craig Nicholson read the letter into the record.  Ms. Delaney cited the Wetlands Regulations regarding septic upgrades which are exempt from the Rivers Protection Act.

8:00 PM  Continued Notice of Intent for construction of access drive, utilities, buildings and related grading partially within the 100-foot buffer zone at 255 rear Liberty St., Assessor's Map 82, Plot 6-1 for Dennis Leary, 2 Columbia Rd., Pembroke, MA represented by Keefe Assoc., Hudson Park Realty Assoc. RT, 2 Columbia Rd., Pembroke, MA  02359  (DEP #175-433)

Dennis Leary and representatives, John Keefe and John Burnes of Keefe Associates attended the hearing as well as Brook Munro who did the delineation.   Mr. Keefe presented a new plan that showed the existing dirt road and a proposal to fill 1,800 sq. feet of wetlands with a replication area of 3,600 sq.ft. in another area.  Currently, the road is creating a wetland area by pooling water over to one side.  There is a question as to whether the roadway, which has been there for approximately two years was previously a wetland area or was creating a wetland area.  Mr. Lindquist suggested that the road was an old cart path.  An abutter, Mr. Peter Guidaboni of 255 Liberty Street stated that the road was not the old cartpath.   Mr. Lindquist requested that Ms. Delaney try to get an accurate soil reading so that a determination can be made of the history of the road.   A site walk was scheduled for Monday, August 16th with the agent, Craig Nicholson and Brook Munro.

8:30 PM  Request for Determination of Applicability for the excavation, grading, tree removal, stump removal, septic tank and pump chamber installation within the buffer zone of a Bordering Vegetated Wetland at 99 Andrew Lane, Assessor's Map 80, Lot 152 for owner Charles Albert represented by Alan Dias, P.O. Box 314, Monponsett, MA  02350.  (New Hearing)

Craig Nicholson read the Public Hearing Notice and the green cards were checked.  Alan Dias made a presentation for a proposal of a septic upgrade.  Walter Hewittson did the wetland delineation.  Mr. Dias would like to change the haybale line and eliminate a block retaining wall.  He will submit a new plan by the end of the week showing the changes.  Ms. Delaney had inspected and commented that the wetlands were loaded with debris and grass clippings.  She suggested that a condition be added to prohibit the owners from putting landscape debris in the wetlands in the future. Mr. Lindquist read the abutters list.  None were present

9:15  PM  Public Hearing to establish  a rule promulgated under  M.G.L. Chapter 44, Section 53G to impose reasonable fees for the employment of outside consultants deemed necessary by the Commission to come to a final decision on an application pursuant to the requirements of the Wetlands Protection Act (GL Ch. 131, Sec.40) and the Hanson By-Law 1-13, Sec. 5.

This rule gives the Board discretion to charge fees for review of plans from submittals to the Commission.  Ms. Delaney offered a draft fee schedule.   Ms. Delaney suggested that the fee schedule be utilized on a case by case basis.   Craig Nicholson asked if there was an appeal process for applicants.  Ms. Delaney answered that there was and it is spelled out in the text of the General Law.  

Motion to establish the Rule presented in M.G.L. Chapter 44, Section 53G (Employment of Outside Consultants) and accept the proposed fee schedule:  Ron Grattan

Appointments

8:45 PM  Appointment with Joanne Cameron to discuss the possibility of using two lots on  Holly Ridge Lane as access to an isolated lot.

Ms. Cameron was advised to consult with an engineer as the Board cannot speculate on a proposed project until a plan is submitted.

9:00 PM  Appointment with Kenneth Sweezey of 51 Mattakeesett Street to discuss on-going conditions at his property so that a Certificate of Compliance may be issued.  (DEP #’s 175-324 & 175-198)

Mr. Sweezey and Azu Etoniru, P.E. attended.  Agent Delaney cited several conditions that were in question such as the temporary crossing that is still in use, a shed not shown on the plan, a row of red maples that should have been planted and a backwash pit not shown on plan.  Ms. Delaney suggests that any changes in the original Orders of Conditions should be spelled out in the Certificate of Compliance request and shown on new as-builts.  Mr. Lindquist would like the silt fence removed, landscaping debris disposed of, the backwash pit shown on the as-built and a row of red maples planted every 20-feet.

Progress report of Whitman/Hanson Regional H.S. construction & mitigation plan – Janine Delaney has reviewed the file and had a meeting with Ernie Sandland, Clerk of the Works.  Apparently, they installed the gas line without contacting the Commission first as stated in the Orders of Conditions.  Ms. Delaney will be meeting with consultant Sharon Leporte onsite to discuss the mitigation plan.

Discussion of applications received for position of Conservation Agent – The Commission has received three applications.  Mr. Lindquist acquired a model for job description from the MACC website.  He will be contacting the applicants to possibly set up interviews.  A discussion ensued with regard to the need for the position of a full-time agent.   Mr. Lindquist suggested that the position of agent is essential not only for checking wetland line delineations, but planning and developing Open Space and obtaining grants.   It was decided to submit an Article to the Selectman for inclusion in the October 4, 2004 Town Meeting.

Policy for filing procedures in the 100-foot buffer zone regarding construction of decks – Ms. Delaney asked the Board if there is a Building Permit for a deck, it’s out of the 50-foot no disturb zone and no heavy equipment is being used only sonar tubes, should she sign off on them.  The Board answered yes.
